The Legal Battle

Lodha filed a probate application (PLA 204 of 2004), which contained the original or a copy of the will, an affidavit of assets left behind by the author of the will, Priyamvada Birla, her death certificate and a no-intimation certificate saying that he had not filed for probate in any other court...

Legal opinions

Could Priyamvada have really bequeathed everything to an outsider leaving nothing to her near and dear next of kin? Or was she coerced into making the will? The fact that a certified copy was not made available to the members raised doubts about its veracity and its contents...

The Road Ahead

It was not that registered wills had not been overturned in India in the past. There were several other routes the Birlas could take to try and overturn the will. They could try to prove that R.S. Lodha misused his position to change the content of the will. But this argument had limitations, as Lodha's fiduciary responsibilities were limited...
